    FIRST SUPPLEMENT

    TO THE JOINT ORDER OF THE BEE COUNTY JUDGE AND THE MAYOR OF BEEVILLE TO

    STAY AT HOME

     

    WHEREAS, on March 27, 2020, the Bee County Judge and the Mayor of Beeville issued a Joint Order to Stay at Home (the “Order”); and

    WHEREAS, this First Supplement does not replace any part of the Order, but rather adds to it to provide additional guidance for religious institutions and access to the same, and append to the Order as Exhibit B, the comprehensive list of critical infrastructure and workers from the Cybersecurity and Infrastructure Security Agency of the U.S. Department of Homeland Security, which was incorporated fully into the Order on March 27, 2020, but not specifically listed out.

    NOW, THEREFORE, UNDER THE AUTHORITY OF TEXAS GOVERNMENT CODE SECTION 418.108, THE MAYOR OF THE CITY OF BEEVILLE AND THE COUNTY JUDGE OF BEE COUNTY, TEXAS, JOINTLY ORDER:

    1.                  Section III.1.e. is supplemented by adding the following language at the end of the provision:

    Provided that such activities comply with the terms of this provision and provided that there is no gathering of the public outside of vehicles in violation of the other provisions of the Order, religious institutions may conduct “drive-in” style church services whereby congregants remain in their vehicles and services are delivered either through loudspeaker, radio or other broadcast means.

    2.                  Section III.2.a. is supplemented by adding a new provision, Section III.2.a.vi., as follows:

    III.2.a.vi.   To attend “drive-in” style church services as allowed for in Section III.1.e., provided that there is no gathering of the public outside of vehicles in violation of the other provisions of the Order.

    3.                  Section III.2.b.iii. is supplemented to include within the parenthetical immediately following “ . . . National Cybersecurity and Infrastructure Agency” the following:

    attached hereto as Exhibit B and incorporated as if fully set forth herein

    4.                  Section III.2.b.iii. is supplemented to include within the list of essential critical infrastructure the business and outreach offices of religious institutions.

    This First Supplement and the terms, provisions and conditions set forth herein are incorporated into and made a part of the Order for all purposes. Except as specifically supplemented herein, the Order is hereby ratified and confirmed as written

    EXHIBIT B

    Healthcare/Public Health

    •     Workers providing COVID-19 testing; Workers that perform critical clinical research needed for COVID-19 response

    •     Caregivers (e.g., physicians, dentists, psychologists, mid-level practitioners, nurses and assistants, infection control and quality assurance personnel, pharmacists, physical and occupational therapists and assistants, social workers, speech pathologists and diagnostic and therapeutic technicians and technologists)

    •     Hospital and laboratory personnel (including accounting, administrative, admitting and discharge, engineering, epidemiological, source plasma and blood donation, food service, housekeeping, medical records, information technology and operational technology, nutritionists, sanitarians, respiratory therapists, etc.)

    •     Workers in other medical facilities (including Ambulatory Health and Surgical, Blood Banks, Clinics, Community Mental Health, Comprehensive Outpatient rehabilitation, End Stage Renal Disease, Health Departments, Home Health care, Hospices, Hospitals, Long Term Care, Organ Pharmacies, Procurement Organizations, Psychiatric Residential, Rural Health Clinics and Federally Qualified Health Centers)

    •     Manufacturers, technicians, logistics and warehouse operators, and distributors of medical equipment, personal protective equipment (PPE), medical gases, pharmaceuticals (including materials used in radioactive drugs), blood and blood products, vaccines, testing materials, laboratory supplies, cleaning, sanitizing, disinfecting or sterilization supplies, and tissue and paper towel products

    •     Food manufacturer employees and their supplier employees—to include those employed in food processing (packers, meat processing, cheese plants, milk plants, produce, etc.) facilities; livestock, poultry, seafood slaughter facilities; pet and animal feed processing facilities; human food facilities producing by-products for animal food; beverage production facilities; and the production of food packaging

    •     Farm workers to include those employed in animal food, feed, and ingredient production, packaging, and distribution; manufacturing, packaging, and distribution of veterinary drugs; truck delivery and transport; farm and fishery labor needed to produce our food supply domestically

    •     Farm workers and support service workers to include those who field crops; commodity inspection; fuel ethanol facilities; storage facilities; and other agricultural inputs

    •     Employees and firms supporting food, feed, and beverage distribution, including warehouse workers, vendor-managed inventory controllers and blockchain managers

    •     Workers supporting the sanitation of all food manufacturing processes and operations from wholesale to retail

    •     Company cafeterias - in-plant cafeterias used to feed employees

    •     Workers in food testing labs in private industries and in institutions of higher education

    •     Natural gas processing plants, and those that deal with natural gas liquids

    •     Manufacturers and distributors (to include service centers and related operations) of packaging materials, pallets, crates, containers, and other supplies needed to support manufacturing, packaging staging and distribution operations

    •     Postal and shipping workers, to include private companies

    •     Employees who repair and maintain vehicles, aircraft, rail equipment, marine vessels, and the equipment and infrastructure that enables operations that encompass movement of cargo and passengers

    •     Air transportation employees, including air traffic controllers and maintenance personnel, ramp workers, aviation and aerospace safety, security, and operations personnel and accident investigations

    •     Workers who support the maintenance and operation of cargo by air transportation, including flight crews, maintenance, airport operations, and other on- and off- airport facilities workers

     

    Public Works

    •     Workers who support the operation, inspection, and maintenance of essential dams, locks and levees

    •     Workers who support the operation, inspection, and maintenance of essential public works facilities and operations, including bridges, water and sewer main breaks, fleet maintenance personnel, construction of critical or strategic infrastructure, traffic signal maintenance, emergency location services for buried utilities, maintenance of digital systems infrastructure supporting public works operations, and other emergent issues

    •     Workers such as plumbers, electricians, exterminators, and other service providers who provide services that are necessary to maintaining the safety, sanitation, and essential operation of residences

    •     Support, such as road and line clearing, to ensure the availability of needed facilities, transportation, energy and communications

    •     Support to ensure the effective removal, storage, and disposal of residential and commercial solid waste and hazardous waste

     

    Communications and Information Technology

    Communications:

    •     Maintenance of communications infrastructure- including privately owned and maintained communication systems- supported by technicians, operators, call-centers, wireline and wireless providers, cable service providers, satellite operations, undersea cable landing stations  (including cable marine depots and submarine cable ship operators), Internet Exchange Points, and manufacturers and distributors of communications equipment

    •     Workers who support radio, television, and media service, including, but not limited to front line news reporters, studio, and technicians for newsgathering and reporting

    •     Workers at Independent System Operators and Regional Transmission Organizations, and Network Operations staff, engineers and/or technicians to manage the network or operate facilities

    •     Engineers, technicians and associated personnel responsible for infrastructure construction and restoration, including contractors for construction and engineering of fiber optic cables

    •     Installation, maintenance and repair technicians that establish, support or repair service as needed

    •     Central office personnel to maintain and operate central office, data centers, and other network office facilities

    •     Customer service and support staff, including managed and professional services as well as remote providers of support to transitioning employees to set up and maintain home offices, who interface with customers to manage or support service environments and security issues, including payroll, billing, fraud, and troubleshooting

    •     Dispatchers involved with service repair and restoration

     

    Information Technology:

    •     Workers who support command centers, including, but not limited to Network Operations Command Center, Broadcast Operations Control Center and Security Operations Command Center

    •     Data center operators, including system administrators, HVAC & electrical engineers, security personnel, IT managers, data transfer solutions engineers, software and hardware engineers, and database administrators

    •     Client service centers, field engineers, and other technicians supporting critical infrastructure, as well as manufacturers and supply chain vendors that provide hardware and software, and information technology equipment (to include microelectronics and semiconductors) for critical infrastructure

    •     Workers responding to cyber incidents involving critical infrastructure, including medical facilities, SLTT governments and federal facilities, energy and utilities, and banks and financial institutions, and other critical infrastructure categories and personnel

    •     Workers supporting the provision of essential global, national and local infrastructure for computing services (incl. cloud computing services), business infrastructure, web-based services, and critical manufacturing

    •     Workers supporting communications systems and information technology used by law enforcement, public safety, medical, energy and other critical industries

    •     Support required for continuity of services, including janitorial/cleaning personnel

     

    Other Community-based Government Operations and Essential Functions

    •     Workers to ensure continuity of building functions

    •     Security staff to maintain building access control and physical security measures

    •     Elections personnel

    •     Federal, State, and Local, Tribal, and Territorial employees who support Mission Essential Functions and communications networks

    •     Trade Officials (FTA negotiators; international data flow administrators)

    •     Weather forecasters

    •     Workers that maintain digital systems infrastructure supporting other critical government operations

    •     Workers at operations centers necessary to maintain other essential functions

    •     Workers who support necessary credentialing, vetting and licensing operations for transportation workers

    •     Customs workers who are critical to facilitating trade in support of the national emergency response supply chain

    •     Educators supporting public and private K-12 schools, colleges, and universities for purposes of facilitating distance learning or performing other essential functions, if operating under rules for social distancing

    •     Hotel Workers where hotels are used for COVID-19 mitigation and containment measures

     

    Critical Manufacturing

    •     Workers necessary for the manufacturing of materials and products needed for medical supply chains, and for supply chains associated with transportation, energy, communications, food and agriculture, chemical manufacturing, nuclear facilities, the operation of dams, water and wastewater treatment, emergency services, and the defense industrial base. Additionally, workers needed to maintain the continuity of these manufacturing functions and associated supply chains.

     

    Hazardous Materials

    •     Workers at nuclear facilities, workers managing medical waste, workers managing waste from pharmaceuticals and medical material production, and workers at laboratories processing test kits

    •     Workers who support hazardous materials response and cleanup

    •     Workers who maintain digital systems infrastructure supporting hazardous materials management operations

     

    Financial Services

    •     Workers who are needed to process and maintain systems for processing financial transactions and services (e.g., payment, clearing, and settlement; wholesale funding; insurance services; and capital markets activities)

    •     Workers who are needed to provide consumer access to banking and lending services, including ATMs, and to move currency and payments (e.g., armored cash carriers)

    •     Workers who support financial operations, such as those staffing data and security operations centers

     

    Chemical

    •     Workers supporting the chemical and industrial gas supply chains, including workers at chemical manufacturing plants, workers in laboratories, workers at distribution facilities, workers who transport basic raw chemical materials to the producers of industrial and consumer goods, including hand sanitizers, food and food additives, pharmaceuticals, textiles, and paper products.

    •     Workers supporting the safe transportation of chemicals, including those supporting tank truck cleaning facilities and workers who manufacture packaging items

    •     Workers supporting the production of protective cleaning and medical solutions, personal protective equipment, and packaging that prevents the contamination of food, water, medicine, among others essential products

    •     Workers supporting the operation and maintenance of facilities (particularly those with high risk chemicals and/or sites that cannot be shut down) whose work cannot be done remotely and requires the presence of highly trained personnel to ensure safe operations, including plant contract workers who provide inspections

    •     Workers who support the production and transportation of chlorine and alkali manufacturing, single-use plastics, and packaging that prevents the contamination or supports the continued manufacture of food, water, medicine, and other essential products, including glass container manufacturing

     

    Defense Industrial Base

    •     Workers who support the essential services required to meet national security commitments to the federal government and U.S. Military. These individuals, include but are not limited to, aerospace; mechanical and software engineers, manufacturing/production workers; IT support; security staff; security personnel; intelligence support, aircraft and weapon system mechanics and maintainers

    •     Personnel working for companies, and their subcontractors, who perform under contract to the Department of Defense providing materials and services to the Department of Defense, and government-owned/contractor- operated and government-owned/government-operated facilities

    of the Bee County Judge and the Mayor of Beeville to

    Stay at Home

    WHEREAS, the novel coronavirus (COVID-19) is recognized globally as a contagious respiratory virus and on March 11, 2020, was declared a pandemic by the World Health Organization; and

    WHEREAS, the Honorable Greg Abbott, Governor of the State of Texas, on March 13, 2020 certified that COVID-19 posed an imminent threat of disaster for all counties in Texas in accordance with the authority vested to the Governor in Section 418.014 of the Texas Government Code; and

    WHEREAS, the President’s Coronavirus Guidelines for America, as promulgated by President Donald J. Trump and the CDC on March 16, 2020, call upon Americans to slow the spread of COVID-19 by avoiding social gatherings in groups of more than 10 people, using drive-thru, pickup, or delivery options at restaurants and bars, and avoiding visitation at nursing homes, among other steps;and

    WHEREAS, the Texas Department of State Health Services has now determined that, as of March 19, 2020, COVID-19 represents a public health disaster within the meaning of Chapter 81 of the Texas Health and Safety Code; and

    WHEREAS, Greg Abbott, Governor of Texas, issued Executive Order GA08 relating to COVID-19 preparedness and mitigation on March 19, 2020, further restricting the assembly of people in groups larger than 10, restricting the public from entering certain enumerated establishments, and restricting visitations to certain facilities in most circumstances; and

    WHEREAS, on March 23, 2020, the Bee County Commissioners’ Court continued the state of disaster initially proclaimed on March 17, 2020, by Joint Order of the Bee County Judge and the Mayor of the City of Beeville; and

    WHEREAS, on March 24, 2020, the City Council of the City of Beeville continued the state of disaster initially proclaimed on March 17, 2020, by Joint Order of the Bee County Judge and the Mayor of the City of Beeville; and

    WHEREAS, this disaster, this worldwide pandemic, requires emergency measures be taken to mitigate and prevent the spread of and control the risk of COVID-19 in order to protect and promote the public health, safety and welfare of all residents of Beeville and Bee County; and

    WHEREAS, given the ongoing evaluation of circumstances related to the COVID-19 virus, the updated recommendations of the CDC and the Texas Department of State Health Services (“TXDSHS”), and the substantial risks posed by the COVID-19 virus to all residents of Beeville and Bee County, the following extraordinary and immediate measures are hereby declared.

    NOW, THEREFORE, UNDER THE AUTHORITY OF TEXAS GOVERNMENT CODE SECTION 418.108, THE MAYOR OF THE CITY OF BEEVILLE AND THE COUNTY JUDGE OF BEE COUNTY, TEXAS, JOINTLY ORDER:

    Section I

    That the recitals set forth in this Declaration are true and correct and in accordance with Chapter 418 of the Texas Government Code for the City of Beeville and for Bee County, Texas, and are hereby adopted and incorporated without exception herein. This Order is in addition to any previous orders issued by the City of Beeville, the Mayor of the City of Beeville, the Commissioners’ Court or the County Judge and hereby incorporates all previous orders by reference.

    Section II

    The virus that causes COVID-19 is easily transmitted through person-to-person contact, especially in group settings, and it is essential that the spread of the virus be slowed to protect the ability of public and private healthcare providers to handle the influx of new patients and safeguard public health and safety. Because of the risk the rapid spread of the virus, and the need to protect the most vulnerable members of the community, this Order requires all individuals anywhere in the Bee County, Texas, to shelter at their place of residence, except for certain Essential Activities and Essential Businesses.

    Section III

    1.                 Effective at 11:59 p.m. on March 28, 2020, and continuing until 11:59 p.m. on April 8, 2020:

    a.                   All individuals currently living within Bee County are ordered to shelter at their place of residence. For the purposes of this Order, residences include homes, condominiums, townhomes, apartments, duplexes, hotels, motels, shared rentals, recreational vehicles, motor homes, and similar facilities. To the extent individuals are using shared or outdoor spaces, they must at all times as reasonable as possible maintain social distancing of at least six (6) feet from any other person when they are outside their residence. All persons may leave their residences or enter or leave the territorial limits of this County only for Essential Activities, or to provide or perform Essential Governmental Functions, or to operate Essential Businesses, all as defined in Section 2.

    b.                  All business operating within Bee County, except Essential Businesses as defined below in Section 2, are required to cease all activities at facilities located within Bee County. For clarity, businesses may continue operations consisting exclusively of employees or contractors performing activities at their own residences (i.e. working from home). To the greatest extent possible, all Essential Businesses shall comply with the Social Distancing Guidelines attached as Exhibit “A” and incorporated in its entirety, including maintaining six (6) feet social distancing for both employees and the general public.

    c.                   All public or private gatherings of any number of people occurring outside a single household or living unit are prohibited, except as otherwise provided herein. Nothing in this Order prohibits the gathering of members of a household or living unit.

    d.                  Restaurants with or without drive-in or drive-through services and microbreweries, and micro-distilleries may only provide take out, delivery, or drive-through services in such manner consistent with Texas Governor Greg Abbott’s waiver.

    e.                   Religious and worship services may be provided by video and teleconference. Institutions must limit in person staff to 10 people or less in the same room when preparing for or conducting video or teleconference services, and all individuals must follow the Social Distancing Guidelines (including the social distancing guideline of six (6) feet).

    f.                   All elective medical, surgical, and dental procedures are prohibited anywhere in Bee County. Hospitals, ambulatory surgery centers, dental offices, and other medical facilities are directed to identify procedures that are deemed “Elective” by assessing which procedures can be postponed or cancelled based on patient risk considering the emergency need for redirection of resources to COVID-19 response. Elective surgeries and procedures that are designed to reduce risk to patients or treat painful or potentially disabling conditions may be continued.

    2.                  Definitions:

    a.                   For purposes of this Order, individuals may leave their residence only to perform any of the following “Essential Activities”:

                                                                        i.                        To engage in activities or perform tasks essential to their health and safety, or to the health and safety of their family or household members (for example, obtaining medical supplies or medication, visiting a health care professional, or obtaining supplies needed to work from home).

                                                                      ii.                        To obtain necessary services or supplies for themselves and their family or household members, or to deliver those services or supplies to others (for example, food, pet supply, and any other household consumer products, and products necessary to maintain the safety, sanitation, and essential operation of residences.)

                                                                    iii.                        To engage in outdoor activity, provided the individuals comply with the social distancing requirement of six (6) feet (for example, walking, biking, hiking or running). All city and county public parks within the geographic boundaries of Bee County are open for regular hours of operation.

                                                                    iv.                        To perform work providing essential products and services at an Essential Business or to otherwise carry out activities specifically permitted in this Order.

                                                                      v.                        To care for a family member(s) or a pet (or pets) in another household.

    b.                  For purposes of this Order, “Essential Businesses” means:

                                                                        i.                        Essential Healthcare Operations. Healthcare operations, including hospitals, clinics, dentists, pharmacies, pharmaceutical and biotechnology companies, other healthcare facilities, healthcare suppliers, mental health providers, substance abuse service providers, blood banks, medical research, laboratory services, physical therapy, or any related and/or ancillary healthcare services. Home-based and residential-based care for seniors, adults, or children are also considered healthcare operations. Healthcare operations also includes veterinary care and all health and welfare services provided to animals. This exemption shall be viewed broadly to avoid any impacts to the delivery of healthcare. Healthcare operations do not include fitness and exercise gyms and similar facilities. Healthcare operations do not include elective medical, surgical, and dental procedures as established in accordance with Subsection 1(f) of this Order.

                                                                      ii.                        Essential Government Functions. All services provided by local governments needed to ensure the continuing operation of the government agencies to provide for the health, safety and welfare of the public, including any local government entities that are required by law to furnish medical and hospital care for the indigent and needy persons residing in the County. Further, nothing in this order shall prohibit any individual from performing or accessing “Essential Government Functions.” All Essential Government Functions shall be performed in compliance with social distancing requirements of six (6) feet, to the extent possible.

                                                                    iii.                        Essential Critical Infrastructure. Work necessary to the operations and maintenance of any of the sixteen (16) critical infrastructure sectors, including suppliers and distributors, as identified by the National Cybersecurity and Infrastructure Agency (, and including, but not limited to the following sectors: chemical, commercial facilities, communications, critical manufacturing, dams, defense industrial base, emergency services, energy, financial services, food & agriculture, government facilities, healthcare & public health, information technology, nuclear reactors, materials & waste, transportation systems, water & wastewater systems), Texas’ industries and related support businesses, public works construction, residential and commercial construction, airport operations, water, sewer, gas, electrical, oil and gas industry, crude oil storage and transport facilities, refining processes, oil and gas/industry disposal facilities, roads and highways, public transportation, automobile repair, solid waste collection and removal, internet, and telecommunications systems (including the provision of essential global, national, and local infrastructure for computing services, business infrastructure, communications, and web-based services), financial institutions, bail bond sureties, defense and national security-related operations, warehouses, essential manufacturing operations, provided that they carry out those services or that work in compliance with social distancing requirement of six (6) feet, to the extent possible. Essential Businesses providing essential infrastructure should implement screening precautions to protect employees and all activity shall be performed in compliance with the Social Distancing Guidelines attached hereto as Exhibit A. Essential Businesses also include businesses that supply Essential Businesses with the services, support, storage, repairs, equipment or supplies necessary or useful to operate or function effectively. Essential Businesses also include airlines, taxis, and other private transportation providers providing transportation services necessary for Essential Activities and other purposes expressly authorized in this Order;

                                                                    iv.                        Essential Retail. Food service providers, including grocery stores, warehouse stores, big-box stores, liquor stores, gas stations and convenience stores, farmers’ markets that sell food products and household staples. Food cultivation, including farming, fishing, and livestock. Businesses that ship or deliver groceries, food, goods or services directly to residences. Restaurants and other facilities and conveyances that prepare and serve food, but only for delivery or carry out. Schools and other entities that typically provide free services to students or member of the public on a pick-up and take-away basis only. The restriction of delivery or carry out does not apply to cafes and restaurants located within hospital and medical facilities. Laundromats, dry cleaners, and laundry service providers. Gas Stations, auto-supply, auto and bicycle repair, hardware stores, landscaping, and related facilities. Businesses that supply products needed for people to work from home. Additionally, in accordance with the March 27, 2020, Opinion KP-0296, of Texas Attorney General Ken Paxton, and the relevant law relied upon therein, firearm retailers are included within the definition of “Essential Retail.”

                                                                      v.                        Providers of Basic Necessities to Economically Disadvantaged Populations. Business that provide food shelter, and social services, and other necessities of life for economically disadvantaged or otherwise needy individuals.

                                                                    vi.                        Essential Services Necessary to Maintain Essential Operations of Residences or Other Essential Businesses. Trash and recycling collection, processing and disposal, mail and shipping services, building cleaning, maintenance and security, warehouse/distribution and fulfillment, storage for essential businesses, funeral homes, crematoriums and cemeteries, hotels and motels, recreational vehicles parks, and public storage facilities. Plumbers, electricians, roofers, exterminators, air conditioner repair, appliance repair, equipment repair, windmill and water well servicers, and other service providers who provide services that are necessary to maintaining the safety, sanitation, and essential operations of residences and Essential Businesses. Professional services, such as insurance, title, real estate, legal or accounting services when necessary to assist in compliance with legally mandated, prohibited, or necessary activities, including the entry of contracts for Essential Businesses or support thereof. Automobile, large truck, and RV dealerships (sales and services centers) in support of transportation. Businesses that supply other essential businesses with support or supplies needed to operate.

                                                                  vii.                        News Media. Newspapers, television, radio, and other media services.

                                                                viii.                        Childcare Services. Childcare facilities providing services that enable employees exempted in this Order to work as permitted.

    3.                  Any manufacturer who retools so that a substantial part of their business is for the purpose of manufacturing and producing ventilators may apply for an “essential business” exemption under this Order. Application for exemption shall be made with the County Judge.

    4.                  If someone in a household has tested positive for COVID-19, the household is ordered to isolate at home for a period of at least 14 days after the person has tested negative for COVID-19 or left the household or such longer period as determined by their physician or the TXDHSH. Members of the household cannot go to work, school, or any other community function.

    5.                  Nursing homes, retirement, and long-term care facilities are instructed by this order to prohibit non-essential visitors from accessing their facilities unless to provide critical assistance or for end-of-life visitation.

    6.                  Additionally, the Office of the Bee County Judge and the Mayor of the City of Beeville instructs all employees to remain at home if sick, and to promptly communicate with an appropriate health care professional.

    Section IV

    This Order shall be effective until 11:59 p.m. on April 8, 2020, or until it is either rescinded, superseded, or amended pursuant to applicable law.

    Section V

    Both the City of Beeville and Bee County shall promptly post copies of this Order on each governmental entity’s webpage. In addition, the owner, manager, or operator of any facility that is likely to be impacted by this Order is strongly encouraged to post a copy of this Order onsite and to provide a copy to any member of the public asking for a copy. If any subsection, sentence, clause, phrase, or word of this Order or any application of it to any person, structure, gathering, or circumstance is held to be invalid or unconstitutional by a decision of a court of competent jurisdiction, then such decision will not affect the validity of the remaining portions or applications of this Order.

    Section VI

    All typical routes of ingress and egress (roads and streets, county roads, state and other highways, Interstate highways) throughout Bee County (including all of Bee County’s incorporated and unincorporated areas) shall remain open and accessible, except to the extent specifically limited by Section 2.a.iii of this Order.

    Section VII

    This Order applies to all incorporated and unincorporated areas of Bee County.

    Section VIII

    A violation of this order is a violation of the emergency management plans of the City and County. A person who violates any provision of this order may be punishable by a fine of up to $500 per violation and additional amounts as authorized by law.

    Section IX

    All Beeville and Bee County officials and employees are authorized to do any and all things necessary or convenient to accomplish the purpose of this Order.

    Exhibit A

    Social Distancing and Travel Recommendations

    1.                  Avoid traveling to other jurisdictions unless essential for work or health.

    2.                  Vulnerable Populations: Limit Outings

    ·                     Vulnerable populations include people who are:

    à                    60 years old and older.

    à                    People with certain health conditions such as heart disease, lung disease, diabetes, kidney disease and weakened immune systems.

    ·                     For vulnerable populations, do not go to gatherings unless it is essential. Stay home. Avoid people who are sick.

    3.                  Workplace and Businesses: Minimize Exposure

    ·                     Suspend nonessential employee travel

    ·                     Ensure employees practice social distancing and do not work within six (6) feet of one another.

    ·                     Urge essential employees to stay home when they are sick and maximize flexibility in sick leave benefits.

    ·                     Do not require a doctor's note for employees who are sick.

    ·                     Maximize telecommuting options.

    ·                     Persons who need to be at work to provide essential services of great benefit to the community must take steps in their workplace to minimize risk.

    4.                  Cancel Non-essential events

    ·                     Cancel non-essential events.

    ·                     Do not attend any events or gatherings if sick.

    ·                     For events that aren't cancelled, we recommend:

    à                    Provide hand washing, hand sanitizers stations and make tissues available.

    à                    Frequently clean high-touch surface areas like counter tops and hand rails.

    à                    Finding ways to implement social distancing.

    5.                  Schools Safety First

    ·                     Do not have your child attend school if sick.

    ·                     If you have a child with chronic health conditions, consult the child's doctor about school attendance.

    ·                     Schools should equip all classrooms with hand sanitizers and tissues.

    ·                     Recommend rescheduling or cancelling events that are not essential.

    ·                     Explore remote teaching and online options to continue learning.

    ·                     Schools should develop a plan for citywide school closures, and families should prepare for further closures.

    6.                  Transit: Cleaning and Protection

    ·                     Increase cleaning of vehicle and high touch surface areas.

    ·                     Provide hand washing/hand sanitizers and tissues in stations and on vehicles.

    ·                     Ensure social distancing practices are implemented to the full extent possible.

    7.                  Health Care Setting: Avoid as possible, protect the vulnerable.

    ·                     Long-term care facilities should have a COVID-19 plan in accordance with CDC or state guidelines.

    ·                     Long-term care facilities should restrict all visitation except for certain compassionate care situations, such as end of life situations.

    ·                     The general public should avoid going to medical settings such as hospitals, nursing homes and long-term care facilities, even if you are not ill.

    ·                     If you are ill, call your health care provider ahead of time, and you may be able to be served by phone.

    ·                     Do not visit emergency rooms unless it is essential.

    ·                     Follow guidance and directions of all facilities.

    8.                  Everyone: Do your part

    The best way for all Bee County residents to reduce their risk of getting sick, as with seasonal colds or the flu, still applies to prevent COVID-19:

    ·                     Wash hands with soap and water for at least twenty (20) seconds.

    ·                     Cough or sneeze into your elbow or a tissue. Throw the tissue in the trash.

    ·                     Stay home if you are sick.

    ·                     Avoid touching your face.

    ·                     Try alternatives to shaking hands, like an elbow bump or wave.

    ·                     If you have recently returned from a country, state or region with ongoing COVID-19 infections, monitor your health and follow the instructions of public health officials and CDC guidelines.

    ·                     There is no recommendation to wear masks at this time to prevent yourself from getting sick.

    You can also prepare for the disruption caused by an outbreak. Preparedness actions include:

    ·                     Prepare to work from home if that is possible for your job, and your employer.

    ·                     Make sure you have a supply of all essential medications for your family.

    ·                     Prepare a childcare plan if you or a caregiver are sick.

    ·                     Make arrangements about how your family will manage school closures.

    ·                     Plan for how you can care for a sick family member without getting sick yourself.

    ·                     Take care of each other and check in by phone with friends, family and neighbors that are vulnerable to serious illness or death if they get COVID-19.

    ·                     Keep common spaces clean to help maintain a healthy environment for you and others. Frequently touched surfaces should be cleaned regularly with disinfecting sprays, wipes or common household cleaning products.

    ORDEN CONJUNTA DEL CONDADO DE BEE Y EL ALCALDE DE BEEVILLE PARA

    Que el 11 de marzo, 2020, el nuevo coronavirus (COVID – 19) es reconocido globalmente como un virus respiratorio contagioso y, fue declarado una pandemia por la Organización Mundial de la Salud.

    Que el 13 de marzo, 2020 en la sección 418.014 del Código del Gobierno de Texas, El Honorable Greg Abbott, Gobernador del Estado de Texas, certificó que el COVID- 19 es una amenaza de desastre para todos los condados in Texas de acuerdo con la autoridad establecida para el Gobernador Texas; y

    Que el 16 de marzo, 2020 El presidente Donald J.     Que en orden de proteger y promover la salud pública, seguridad y bienestar de todos los residentes de Beeville y del Condado de Bee se requieren tomar medidas que mitiguen y prevengan la propagación y el riesgo de contagio de esta pandemia global COVID-19.

    Que dada la continua evaluación de las circunstancias relacionadas con el virus COVID-19; las recomendaciones actualizadas del CDC y del Departamento de Servicio de Salud de Texas (“TXDSHS”) , y el riesgo substancial del virus COVID-19, por el presente se ha declarado las siguientes medidas extraordinarias.

    AHORA, POR LO TANTO BAJO LA AUTORIDAD DEL GOBIERNO DE TEXAS EN LA CECCION 418.108, EL ALCALDE DE LA CIUDAD DE BEEVILLE Y EL JUEZ DEL CONDADO DE BEE , TEXAS , CONJUNTAMENTE DECRETAN:

    SECCIÓN I

    SECCIÓN III

    a.                     Todos los individuos que viven actualmente en el Condado de Bee se les ordena que se resguarden en su lugar de residencia.     e.                     Servicios religiosos y de adoración pueden ser suministrados a través de video y video conferencia.     2.      Definiciones:

    a.                      Para propósito de esta Decreto, los individuos sólo pueden dejar sus residencias cuando van a realizar alguna de las siguientes “Actividades Esenciales”:

                                                          i.               Para participar en actividades y elaborar tareas esenciales para su salud y seguridad o para la salud y seguridad de su familia y miembros de su casa (por ejemplo, obtener suministros médicos o medicación, visitar a un profesional de la salud, u obtener suministros necesarios para el trabajo en casa).

                                                        ii.              Para obtener los servicios necesarios o suministros para ellos mismos y su familia o los miembros de su casa, o para entregar a domicilio esos servicios o suministros a otros(por ejemplo , comida, suministros para las mascotas, y cualquier otro producto que consuman en la casa, y productos necesarios para mantener la seguridad, saneamiento, y operación esencial de las residencias.)

                                                      iii.              Para participar en actividades al aire libre, con tal que los individuos cumplan con los requerimientos de distanciamiento social de seis (6) pies (por ejemplo, caminar, montar bicicleta, senderismo o correr). Todos los parques públicos de la ciudad y el condado entre los límites geográficos del Condado de Bee están abiertos en sus horas regulares de operación.

                                                      iv.              Para trabajar proveyendo productos esenciales y servicios en un establecimiento esencial o de lo contrario llevar a cabo actividades específicamente permitidas en este Decreto.

                                                        v.              Para cuidar de un miembro(s) de la familia o una mascota(s) en otra casa.

    b.                    Para propósito de este Decreto, “Negocios Esenciales” se define como:

                                                          i.              Operaciones Esenciales de la Salud . Operaciones de Salud, incluyendo hospitales, clínicas, dentistas, farmacias, compañías farmacéuticas y de biotecnología, otras instalaciones de salud, suministros de salud, proveedores de salud mental proveedores de servicios de abuso de sustancias, bancos de sangre, investigación médica, servicios de laboratorios, terapia física, o cualquier relacionado y/o servicios auxiliares de salud. Trabajo a domicilio y cuidado residencial para personas mayores de la tercera edad, adultos, o niños también son considerados operaciones de salud. Operaciones de salud también incluye cuidado veterinario y todo el servicio de bienestar para los animales.                                                       iii.              Infraestructuras Criticas Esenciales. Es el trabajo necesario para mantener las operaciones y mantenimiento de los dieciséis (16) sectores críticos de la infraestructura, incluyendo suministros y distribuidores , como han sido identificados por la Agencia Nacional de Ciberseguridad e Infraestructura (,e incluyendo, pero no limitado a los siguientes sectores: químico, instalaciones comerciales, comunicaciones, manufacturación critica, presas, industria de defensa, servicios de emergencia, electricidad, servicios financieros, comida & agricultura, instalaciones del gobierno, salud pública , información tecnológica, reactores nucleares, materiales & desechos, sistemas de transportación, agua & sistemas de agua residuales), Industrias Texanas y negocios de apoyo relacionados con, construcción publica, construcción residencial y comercial, operación en los aeropuertos, agua, aguas residuales, gas, electricidad, industria de gas y petróleo, instalaciones de almacenamiento de petróleo crudo y de transporte, procesos de refinamiento, instalaciones de eliminación de la industria del petróleo y gas, carreteras y autopistas,transporte público, reparación de automóviles, recogida de residuos sólidos y basura, servicios de internet, y sistemas de telecomunicaciones (incluyendo la provisión de servicios esenciales de la infraestructura global, nacional, y local de las comunicaciones y servicios basados en la web), instituciones financieras, garantías de fianzas, operaciones relacionadas con la defensa y seguridad nacional, bodegas, operaciones esenciales de manufactura, Siempre que realicen esos servicios y trabajo cumpliendo a la medida de lo posible con los requerimientos de distanciamiento social de seis (6) pies. Los negocios Esenciales que proveen infraestructura esencial deben implementar procesos para detectar y proteger a los empleados y todas las actividades deben ser realizadas satisfaciendo las medidas de distanciamiento social. Pautas adjuntas a este documento como Exhibición A. Negocios esenciales también incluyen negocios que proveen a los negocios de servicios esenciales con servicios, apoyo, almacenamiento, reparación, equipos y suministros necesarios para operar o funcionar efectivamente. Negocios Esenciales también incluye aerolíneas, taxis, y otros proveedores de transportación privados que provean servicios de transportación necesarios para actividades Esenciales y otros propósitos expresamente autorizados en este Decreto.

                                                      iv.              Negocios esenciales. Proveedores de servicios de comida, incluyendo tiendas de comestibles, tiendas de bodega, Tiendas grandes, tiendas de licor, estaciones de gasolina y tiendas de conveniencia, mercados de agricultores que vendan alimentos y productos caseros. Cultivo de alimentos incluyendo, agricultura, pesca y ganado. Negocios que transportan y entregan víveres, comidas, bienes y servicios directamente a domicilio. Restaurantes y otras instalaciones que preparan y sirven comida pero que solo hacen entrega a domicilio o llevan comida. Escuelas y otras entidades que típicamente provee servicios gratuitos para los estudiantes o miembros del publico solo para recoger y llevar. La restricción de servicio a domicilio y de recoger y llevar no aplica para cafés y restaurantes localizados dentro del hospital e instalaciones médicas. Lavanderías, tintorerías y servicio de lavandería. Estaciones de gasolina, tiendas de repuestos para carros, talleres mecánicos para carros y bicicletas, ferreterías, servicios de jardinería y otras instalaciones relacionadas. Negocios que proveen productos necesarios para las personas que trabajan en casa. Adicionalmente, de acuerdo con la Opinión KP-0296 del 27 de marzo del señor Fiscal General de Texas Ken Paxton y la ley pertinente invocada en el mismo , las tiendas de armas de fuego están incluidas en la definición de “ Negocios esenciales”.

                                                        v.              Proveedores de necesidades básicas para la población de bajos recursos. Los negocios que proveen alimentos, refugio y servicios sociales y otros artículos de primera necesidad para las personas de escasos recursos o personas necesitadas.

                                                      vi.              Servicios esenciales necesarios para mantener las operaciones esenciales de residencias u otros negocios esenciales. Recolección de basura y de reciclaje, procesamiento y eliminación de desechos, correo y servicios de envío y entrega, servicio de limpieza de edificios, mantenimiento y seguridad, cumplimiento de bodega/distribución, almacenamiento para negocios esenciales, funerarias, crematorios y cementerios, hoteles y moteles, estacionamiento de vehículos recreacionales, y lugares de almacenamiento públicos. Plomeros, electricistas, techadores, exterminadores, reparación de aire acondicionados, reparación de electrodomésticos, reparación de maquinaria, reparación de molinos de viento y posos de agua, y otros servicios que proveen servicios que son necesarios para el mantenimiento de la seguridad, saneamiento y operaciones de residencias y negocios esenciales. Servicios profesionales, tales como seguros, compañías de títulos, inmobiliarias, servicios legales y de contaduría cuando sea necesario para ayudar a cumplir con el mandato legal, de las prohibiciones o actividades necesarias, incluyendo la entrada del contrato para negocios esenciales o de los mismos. Concesionarios de (ventas y servicios para vehículos) automóviles, camiones grandes y vehículos recreacionales. Negocios que aprovisionan otros negocios esenciales con servicios y suministros necesarios para operar.

                                                    vii.              Medios de comunicación. Periódicos, televisión, radio y otros servicios de comunicación.

                                                  viii.              Servicios de cuidado para niños. guarderías que proveen servicios que habilitan a los empleados exceptos en este Decreto

    3.      Cualquier fabricante que retoque alguna parte substancial de su negocio con el propósito de fabricar y producir ventiladores, pueden aplicar para una exención de “negocio esencial” bajo este Decreto. La aplicación para la exención deberá hacerla con el Juez del Condado.

    4.      Si alguien en una casa tiene resultado positivo para el COVID-19, se ordenada que todos los miembros del hogar se aíslen en la casa por un periodo de al menos 14 días después que la persona tenga un resultado negativo para el virus COVID-19 o deje la casa o por el periodo de tiempo determinado por su medico o el TXDHSH. Los miembros de la casa no pueden salir al trabajo, o a la escuela o a ninguna actividad en la comunidad.

    5.      Residencia de ancianos, casa de retiro, e instalaciones de cuidado de ancianos a largo tiempo deben seguir las medidas adoptadas bajo este decreto de prohibir la visita de personal no esencial al menos que provean asistencia critica o la visita cuando la persona está próxima a fallecer.

    6.      Adicionalmente, la oficina del Juez del Condado de Bee y el Alcalde de la Ciudad de Beeville instruye a todos los empleados que permanezcan en casa si se enferman, y que prontamente se comunique con el apropiado profesional de la salud.

    SECCIÓN IV

    El Decreto tiene vigencia hasta el 8 de abril,2020 a las 11:59 p.m., o hasta que sea rescindido, reemplazado o modificado de conformidad con la ley aplicable.

    SECCIÓN V

    La Ciudad de Beeville y el Condado de Bee conjuntamente publicará sin demora copias de este Decreto en cada pagina de internet de las entidades gubernamentales. Adicionalmente, el propietario, administrador u operador de cualquier instalación que sea afectada por este decreto se le recomienda que publique una copia de este Decreto en el lugar y que le dé una copia a cualquier miembro del publico que solicite una. Si cualquier subsección, oración, clausula, frase o palabra del Decreto o cualquier aplicación de este para cualquier persona, estructura, conglomerado o circunstancia se considera invalida o inconstitucional por una decisión de la corte de la jurisprudencia pertinente, entonces esa decisión no afectara la validez del resto o aplicación de este decreto.

    SECCIÓN VI

    Todas las rutas típicas de ingreso o egreso (carreteras y calles, carreteras del condado, estado y otras autopistas , autopistas interestatales) que atraviesan el Condado de Bee ( incluyendo todas las áreas incorporadas o no incorporadas del Condado de Bee) deberán permanecer abiertas y accesibles, excepto en la medida limitada especificada en la Sección 2.a.iii de este Decreto.

    SECCIÓN VII

    Este Decreto aplica para todos las áreas incorporadas y no incorporadas del Condado de Bee.

    SECCIÓN VIII

    Una violación a este Decreto es una violación al plan de manejo de emergencia de la Ciudad y del Condado. La persona que viole cualquier provisión en este decreto deberá ser castigado con una multa de hasta $500 por violación y montos adicionales como es autorizado por la ley.

    SECCIÓN IX

    Todos los funcionarios y empleados de Beeville y el Condado de Bee están autorizados de hacer todo lo necesario o conveniente para cumplir el propósito de este Decreto.
